Terms of service

Agreement and eligibility

These terms govern your access to Earthy Studio on the web and in the mobile app. By creating an account, buying credits, or using the service, you agree to these terms, the Privacy Policy, the Content Policy, and the Community Guidelines.

You must be at least 13 and meet any higher minimum digital-consent age where you live. If you are not old enough to enter a contract yourself, a parent or legal guardian must review and accept these terms for you. You must provide accurate account information and keep your sign-in credentials secure.

The service and AI output

Earthy provides prompt-guided tools that can analyze source material and help compose, generate, edit, render, and share video and related media. Available models, templates, editing controls, output formats, and providers can differ by device, location, account, and release.

AI output is probabilistic. It can be inaccurate, unexpected, similar to other output, or unsuitable for your intended audience. Earthy does not guarantee that content will be original, protectable, error-free, accepted by a social platform, or successful or viral. Keyframe approval is your creative review step, not a legal, factual, or safety certification.

Review every output before publishing. Earthy output is not medical, legal, financial, religious, or other professional advice, and it should not be used for emergency, high-risk, or safety-critical decisions.

Your content and permissions

As between you and Earthy, you retain your rights in content you submit. You grant Earthy a worldwide, non-exclusive license to host, copy, transform, analyze, moderate, render, and transmit that content only as needed to operate, secure, support, and provide the service and the sharing or posting actions you request.

You must have all rights, licenses, and permissions needed for prompts, source links, photos, footage, audio, music, logos, trademarks, personal information, and likenesses you submit. A public source link does not give you permission to copy or recreate the linked work. Do not submit another person's private content or likeness, or content involving a child, without the authority and consent required by law.

To the extent allowed by law, you may use generated output created for your account, subject to these terms and any rights belonging to other people. AI output may not qualify for copyright or other exclusive rights, and similar output may be generated for another user. Earthy does not transfer rights it does not own.

Acceptable use and moderation

You may not use Earthy for unlawful, exploitative, deceptive, abusive, infringing, privacy-invasive, or dangerous activity, or to evade safety controls, impersonate a person deceptively, exploit a child, distribute non-consensual intimate content, or misrepresent synthetic media as proof of a real event.

Earthy can use automated and human review to screen inputs and outputs, refuse or stop a render, restrict sharing, preserve safety evidence, remove content, or suspend an account. You can use available appeal tools, but Earthy does not promise a particular review outcome or response time.

You may not probe or disrupt the service, bypass access or payment controls, scrape private areas, introduce malicious code, or use automated access except through an interface Earthy expressly permits.

Credits and rendering

Credits are prepaid service units used for metered creation actions. The applicable cost or estimate is shown before confirmation. Credits are not money, are not transferable, do not earn interest, and cannot be withdrawn for cash except where law requires.

Earthy may place a temporary credit hold when a render starts, then settle the charge when processing finishes. Provider usage, quality checks, or options you approve can affect the final metered amount only as disclosed in the creation flow. If a job does not complete and a held balance is not released, contact support so the transaction can be reviewed.

Pack sizes, prices, taxes, and feature costs can change for future purchases or jobs. A change does not alter a purchase already completed or a render already confirmed, except where required to correct an error or comply with law.

Purchases and refunds

Apple processes in-app purchases made in the iOS app through the App Store and StoreKit. Those purchases are also subject to Apple's terms. Apple controls refund eligibility for App Store purchases. To request one, use reportaproblem.apple.com or follow Apple's official process at support.apple.com/en-us/118223.

Stripe processes purchases made on the Earthy website. Except where applicable law requires otherwise or the checkout screen expressly states otherwise, completed web credit purchases are final. Contact support for duplicate charges, failed fulfillment, or another web purchase problem. Any approved refund can remove the corresponding unused credits.

Your bank, Apple, Stripe, or another payment provider may apply its own processing times, exchange rates, taxes, and terms. Earthy does not store your complete card or Apple payment credentials.

Sharing and third-party services

This release does not offer public user publication or new Earthy share-link creation. You can save output and, where a connected posting option is available, direct Earthy to send it to that service. Content you share outside Earthy can be viewed, downloaded, copied, or reshared by others.

Sign-in providers, payment processors, AI providers, hosting services, and connected social platforms are third-party services with their own terms and privacy practices. Earthy is not responsible for a third-party service's independent decisions, availability, or use of content after you direct Earthy to send it there.

Account suspension and deletion

You can stop using Earthy at any time. Earthy may restrict or suspend access when reasonably necessary for safety, security, legal compliance, payment integrity, or a violation of these terms or the content rules. Where appropriate, Earthy may provide notice or an appeal path.

You can request account deletion from Settings. A deletion request has a 30-day grace period during which it can be canceled. After the grace period, the deletion process removes account content and stored media, revokes Earthy share links, and deletes the sign-in account. Unused credits are forfeited when deletion completes unless applicable law requires otherwise.

Accounting, purchase, consent, moderation, child-safety, fraud, dispute, and audit records may be retained when needed for legal or operational reasons. Earthy severs the direct account link or pseudonymizes those records where the system supports it. The Privacy Policy explains the deletion and retention process in more detail.

Service availability and changes

The service is provided on an as-available basis. Generation depends on networks, app stores, AI providers, and other infrastructure that can fail, delay, refuse, or change output. Earthy does not promise uninterrupted access or a particular processing time.

Earthy may add, change, pause, or remove models, providers, features, limits, or compatibility. If a change materially affects purchased credits or your legal rights, Earthy will provide notice when required and apply the change prospectively where reasonably possible.

Responsibility and legal limits

You are responsible for your inputs, approvals, publishing choices, and use of output, including checking facts, rights, consent, platform rules, advertising disclosures, and synthetic-media labels. You are also responsible for taxes or business obligations arising from your use of output.

Nothing in these terms excludes consumer rights or liability that cannot legally be excluded. To the extent permitted by law, Earthy is not responsible for indirect or consequential loss, lost audience, lost revenue, lost data caused by your device or a third party, or harm caused by content you submit or publish, third-party services, or events outside Earthy's reasonable control.

Changes and contact

Earthy may update these terms as the service or law changes. The current version and date will be posted here. If a change materially reduces your rights, Earthy will provide additional notice when required by law. Continuing to use the service after the effective date means you accept the updated terms, to the extent permitted by law.
